These Terms of Service govern your use of the Frost Byte website and the services provided by Frost Byte.
Frost Byte is a creative studio that designs, develops, hosts and manages custom websites through monthly subscription plans.
By submitting a project request, accepting a proposal, approving a website, creating an account or starting a subscription, you agree to these Terms of Service.
If you are accepting these terms on behalf of a business or organisation, you confirm that you have authority to do so.

Website descriptions and pricing summaries are general. A specific written proposal or service agreement takes priority where it contains different terms.
Frost Byte offers three monthly subscription tiers.
Each tier includes a different level of website design, development, hosting, maintenance and support.
You may also select optional add-ons. Add-ons may include additional pages, CMS functionality, e-commerce, integrations, analytics, ongoing updates, advanced visual assets or other services displayed on the Frost Byte website.
Your monthly subscription price is based on:
Frost Byte will not add a new paid service to your subscription without your approval.
Frost Byte does not normally charge an upfront fee for the initial design and development of a subscription website.
Your monthly subscription begins when:
The first monthly subscription payment must be successfully processed before the website is placed into production or made publicly available, unless otherwise agreed in writing.
Any separate third-party costs that are not included in your subscription will be disclosed before they are incurred.
Website concepts, designs, development files and unpublished project materials remain under Frost Byte’s control before the subscription begins.
If you decide not to continue before launch:
Frost Byte may reuse general ideas, techniques, systems and non-confidential components from an abandoned project.
Frost Byte will not reuse your confidential business information, protected brand assets or supplied content for another client.
Work can begin once Frost Byte has received the information reasonably required for the project.
This may include:
Estimated timelines begin only after the required information has been received.
You agree to:
You are responsible for checking:
Frost Byte is not responsible for errors in content that you supplied or approved.
You retain ownership of the logos, text, images, videos, product information and other materials you provide.
You confirm that:
You are responsible for obtaining any licences, releases or permissions required for supplied content.
Frost Byte may refuse to publish content that appears unlawful, fraudulent, harmful or clearly infringing.
The project scope is based on your selected subscription tier and add-ons.
Requests outside the agreed scope may:
Frost Byte will explain any material price or timeline change before beginning additional paid work.
The number and type of revisions included depend on your selected plan or written proposal.
Feedback should be:
A major change in direction after work has begun may be treated as a change in project scope.
Changes requested after final approval may be handled as ongoing updates, an add-on or separately quoted work.
Frost Byte will provide an opportunity to review the website before launch.
Approval may be provided through:
When you approve the website or instruct Frost Byte to launch it, you confirm that you have reviewed the current version and consider it ready to go live.
Minor errors reported shortly after launch will be corrected where they fall within the agreed project scope.
New features or changes in direction are not considered corrections.
Subscriptions are billed monthly and automatically renew until cancelled.
By starting a subscription, you authorise the approved monthly charge to be processed through Paystack or the payment provider displayed during checkout.
You are responsible for ensuring that your payment details remain valid.
The monthly amount may include:

You may request to:
Changes may take effect immediately or from the next billing period, depending on the service and work involved.
A downgrade or removed add-on may affect:
Frost Byte will explain any significant effect before applying the change.
If a payment fails, Frost Byte may:
Where reasonably possible, Frost Byte will provide notice before taking an existing live website offline.
Immediate suspension may be necessary where there is fraud, unlawful activity or a serious security risk.
Outstanding amounts remain payable.
Hosting is included only where stated in your selected tier or proposal.
No hosting provider can guarantee uninterrupted service. Websites may occasionally be unavailable because of:
Frost Byte will take reasonable steps to restore services under its control.
Domain registration and renewal fees are included only where explicitly stated.
You remain responsible for domains registered in your own name or account.
Your website may use third-party services such as:
These services have their own terms, prices and privacy practices.
Frost Byte does not control third-party systems and cannot guarantee their uninterrupted availability.
Third-party price increases may affect your monthly subscription where the relevant service is necessary for your website. Reasonable notice will be provided before Frost Byte passes on a material increase.
You retain ownership of content and brand assets you provide.
Third-party materials remain subject to their original licences.
Frost Byte retains ownership of its:
Unless otherwise agreed in writing, your subscription gives you the right to use the completed website while your subscription remains active.
Source code, working files and Frost Byte’s reusable systems are not automatically transferred to you.
Website handover, source-code access or permanent ownership is included only where stated in your subscription tier or separately agreed in writing.
Frost Byte may display completed public-facing work in:
Frost Byte will not disclose private analytics, customer information or confidential project information.
You may request confidentiality before the project begins. A separate confidentiality agreement may be required.
Frost Byte provides design and development services. We do not automatically provide legal, tax or regulatory advice.
You remain responsible for making sure your website complies with requirements relevant to your business, including:
Frost Byte may assist with implementing supplied policy content but does not guarantee that the content is legally sufficient for your specific business.
You may not use a Frost Byte website or service for:
Frost Byte may suspend a website where continued operation would create a serious legal, security or reputational risk.
Frost Byte will provide its services with reasonable care and professional skill.
However, we do not guarantee:
Website performance depends on many factors outside Frost Byte’s control.
To the extent permitted by law, Frost Byte is not responsible for loss caused by:
Nothing in these terms excludes liability or rights that cannot lawfully be excluded.
Subscriptions may be cancelled at any time in accordance with the Frost Byte Cancellation Policy.
There is no standard cancellation fee.
Your website and included services normally remain active until the end of the paid billing period.
Hosting and other subscription services may end after that date.
Frost Byte may suspend or terminate a service because of:
Where practical, Frost Byte will provide written notice and a reasonable opportunity to correct the problem.
If a dispute arises, both parties should first attempt to resolve it through good-faith written communication.
Nothing in these terms prevents either party from approaching a competent court, regulator or consumer-protection body.
These Terms of Service are governed by the laws of the Republic of South Africa.
Any mandatory consumer rights that apply to you remain unaffected.
Frost Byte may update these terms when its services, subscription structure or legal obligations change.
Material changes affecting active subscriptions will be communicated with reasonable notice.
